Sometimes a drug arrest can have far greater consequences than you imagine. One of the factors that determine the seriousness of drug charges is the quantity of drugs in your possession. If you have more than a certain amount, you will be presumed to intend to sell it.
At the Zolman Law Firm, our lawyers defend people who are charged with all kinds of drug charges, including possession with intent to sell. We offer a free initial consultation to discuss your case. We have offices in Mid County and South County in St. Louis.
What Quantity of Drugs Constitutes Intent to Sell?
You may be charged with intent to sell or distribute drugs if you have:
- More than 30 grams of heroin
- More than two ounces of cocaine
- More than 500 milligrams of LSD
- More than 30 grams of PCP
- More than 30 kilograms of marijuana
The greater the quantity of drugs, the more serious the consequences. For example, possession of more than two but less than six ounces of cocaine is a class B felony punishable by up to 15 years in prison. Possession of more than six ounces is a class A felony, punishable by up to 30 years or life in prison. To protect yourself from potentially devastating consequences, you should constitute an experienced defense lawyer as soon as possible.
You can also be charged with drug sales or trafficking based on how the drugs are packaged. For example, if PCP pills are packaged individually in plastic bags, police may assume you intended to sell the drugs.
